Terms of Use
Platform licence and statutory responsibilities governing the use of GoFica.
1. Platform licence and usage
GoFica provides a secure cloud software platform for natural-person customer due diligence capture, cryptographic vaulting, and consent management. Use of the platform is subject to an active subscription or verified client invitation.
2. Section 21 statutory liability
Under Section 21 of the Financial Intelligence Centre Act (FIC Act 38 of 2001, as amended), each accountable institution retains full legal liability for establishing and verifying the identity of its clients. GoFica provides verification tools and audit trails, but participating firms cannot outsource their statutory compliance obligations to GoFica.
3. Verification results and simulation notice
In test, sandbox, or demonstration modes, identity verification and screening receipts carry simulation markers (is_simulated = true). Simulated records must never be represented as official Department of Home Affairs receipts or statutory compliance proof.
4. No guarantee of compliance
GoFica is an independent compliance technology platform and is not affiliated with or endorsed by the Financial Intelligence Centre (FIC). Platform readiness metrics indicate workflow completeness and do not constitute legal advice or guarantee regulatory compliance.
